Regulation status

Is my profession regulated in Germany?

Some professions may only be practised once specific qualification, recognition or professional-authorisation requirements are met. Most professions in Germany are not regulated. The first step is the correct German profession, the status is attached to it, not to a job title.

Official status and requirements are confirmed through the Recognition Finder of “Anerkennung in Deutschland” or the competent institution.

Three possible states

German profession

  • Regulated
  • Non-regulated
  • Further clarification needed

The third state is not a failure. It means the German profession is not yet defined enough to carry a status.

What “regulated profession” means

A regulated profession is one whose access or professional title is defined by law.

In these professions people may only work if they hold a very specific qualification. With a foreign qualification, recognition or a professional licence is generally required first. Most professions in Germany are not regulated.

Regulated profession

Law defines access to the profession or the use of its title. A specific qualification, recognition of a foreign qualification, a licence, registration or profession-specific evidence may be required.

Source: Make it in Germany, glossary “Regulated professions”.

Non-regulated profession

Formal recognition is generally not required in order to practise. Qualification evidence may still matter, for employers, for certain residence routes, and for how a foreign qualification is understood.

Source: Anerkennung in Deutschland; ZAB/KMK.

Regulation status describes the legal framework around a profession. It does not answer every recognition, residence or employment question by itself.

One profession, three possible frameworks

What legal access framework applies to the German profession?

Regulated

  • a specific qualification
  • recognition of a foreign qualification
  • licence to practise or registration
  • protected title where it applies

Access is legally defined. Recognition and authorisation to practise can be separate steps.

Non-regulated

  • employer assessment of the profile
  • qualification transparency
  • optional recognition
  • qualification evidence for a residence route

Access is generally not restricted by recognition law. Non-regulated does not mean evidence has no value.

Not yet clear

  • the foreign title is too broad
  • several German professions may fit
  • the title question is unresolved
  • the federal-state context is unknown

A status cannot be attached to a profession that is not yet identified.

The correct pathway begins with the correct German profession.

Regulation depends on the exact profession and context

Six contexts, each with its own source. They illustrate the principle, none of them classifies an individual case.

Nursing and medicine

Named as regulated professions. With a foreign qualification, recognition or a professional licence is generally required before working fully in the profession.

Make it in Germany, glossary “Regulated professions”. Exact requirements depend on the profession and the competent authority.

Teaching

Teachers appear among the named regulated professions. Requirements can differ by school type, subject and federal state.

Make it in Germany; Anerkennung in Deutschland on federal-state law.

Legal professions

Lawyers are named as a regulated profession. Access is tied to a specific qualification rather than to comparable professional experience.

Make it in Germany, glossary “Regulated professions”.

Self-employed master-craft activity

Certain master craftspeople fall under regulation when they work as self-employed entrepreneurs, the same trade may be non-regulated in employment.

Make it in Germany, glossary “Regulated professions”.

Dual-system training occupations

Occupations trained in the German dual system are described as non-regulated: recognition is not a precondition for practising them.

Anerkennung in Deutschland; ZAB/KMK on non-regulated professions.

Academic non-regulated professions

Where a profession is not regulated, a statement of comparability can make a foreign degree understandable to employers without being a precondition for working.

ZAB/KMK, statement of comparability.

Examples give orientation. The exact German profession, the intended activity, the use of a title and the applicable law determine the official status.

What the status changes about the next step

Regulation status is a decision point, not the whole procedure. It changes which question comes next, and which one can wait.

If regulated

  1. recognition of the qualification is generally required
  2. further criteria for authorisation to practise may be assessed
  3. the competent authority follows from profession and place of work
  4. where substantial differences are found, compensation measures may follow

If non-regulated

  1. an application can generally be made directly
  2. the employer assesses the qualification
  3. recognition or a comparability statement remains optional but useful
  4. a residence route may still ask for qualification evidence

If not yet clear

  1. identify the German profession first
  2. structure qualification, activities and responsibility
  3. clarify whether a title is part of the intended work
  4. only then check the status against that profession

Questions about regulated professions

What is a regulated profession in Germany?
A profession whose access or professional title is tied to legal requirements. Working in it requires a very specific qualification; with a foreign qualification, recognition or a professional licence is generally required.
Are most professions in Germany regulated?
No. Most professions are not regulated. Recognition is generally not required in order to practise them.
Which professions are regulated?
Official information names nurses, doctors, teachers and lawyers, and certain master craftspeople working as self-employed entrepreneurs. The status of an individual profession has to be checked for that profession.
Do I always need recognition in a regulated profession?
To work in a regulated profession with a foreign qualification, recognition is generally required. In addition, further criteria for authorisation to practise may be assessed in the procedure.
Do I need recognition in a non-regulated profession?
Generally not in order to practise. It can still be relevant for employers, for entry from a third country and for making a foreign qualification understandable.
Is a protected title the same as a regulated profession?
Title protection can be part of a regulation context, but the two are not identical. Official, informal and legally protected titles have to be distinguished.
Does the federal state matter?
It can. Recognition is governed by federal law and by federal-state legislation, so requirements and the competent authority can differ by region.
Can a non-regulated profession still matter for a visa?
Yes. Recognition can be necessary for entry from a third country even where it is not required in order to practise the profession.
Can proceda decide whether my profession is regulated?
No. proceda App structures profession and process orientation. The official status is confirmed through the Recognition Finder or the competent institution.
What if I do not know the German profession?
Start there. A status belongs to a defined German profession, not to a broad foreign title or an industry.
